The Ninth Circuit Court determined in the 2007 case Porter v. Bowen that efforts in 2000 to swap votes were constitutionally protected by the First Amendment.Under the Win-Win Vote Strategy, nothing of value is being exchanged.  No votes are being swapped or exchanged.  Both the swing state voter and the safe state voter agree to a political coalition-building strategy that advances their interests.In a legislature, Senator A may agree with Senator B that Senator A will vote for Senator B’s bill if Senator B agrees to vote for Senator A’s bill.  There is nothing illegal about this.  It is just political coalition-building.No voter will be pressured to sign Win-Win Vote Strategies.  They will do so under their own volition.The Win-Win Vote Strategies are nonbinding and unenforceable.Voters who participate in the Win-Win Vote Strategy retain complete decision-making power over their choice of whom to vote for at all times, including when they cast their ballot.  Voters will not be bound by their participation in this strategy, and can cast their ballot how they wish.Voters will keep their ballots private and secret.Voters will receive nothing of value in exchange for their decision to cast their ballot in the way that they intend.
